The Honolulu City Council is considering approving a $900,000 settlement with the sons of an elderly woman who was run over by a garbage truck in 2013.

Pauline Ando, 83, was crossing the street in Aiea on Feb. 1, 2013 when a city employee driving a refuse truck reversed and killed her. The City Council is scheduled to approve the settlement Wednesday at Honolulu Hale.

The lawsuit contends that the city has failed to properly train and oversee employees. The complaint, filed in January 2015, says that over the previous five years there were 400 accidents involving city garbage trucks and that a city analysis found 70 percent of these were avoidable.

An attorney for plaintiffs Russell and Marshall Ando declined to comment Tuesday. Andrew Pereira, spokesman for Mayor Kirk Caldwell, said in an email that “the city is unable to provide comment at this time as the lawsuit is still pending and the Council has not yet approved the settlement.”

If the settlement is approved, it won’t be the first that that taxpayers must pay the families of people killed or maimed by refuse truck drivers.

The City Council  inNovember after a garbage truck ran over and killed 70-year-old Barbara Kato in Kalihi in 2014.

In 2014, the city paid $50,000 to a bicyclist hit by a garbage truck.
