But now Windham鈥檚 attorney, Myles Breiner, says this cell phone video calls into question the actions of the two arresting officers.

Here’s the back story, according to media reports and Breiner:

Police were called to Ala Moana Center around 3 a.m.聽after receiving a report about Windham arguing with another person.

Police say Windham attacked the two officers when they were talking to him. He was arrested on two counts of assault on a law enforcement officer and resisting arrest, but was released after being detained for 48 hours without formal charges being filed.

Both officers reported sustaining聽minor injuries and were treated and released from a local hospital.

Breiner provided the cell phone video to Civil Beat. He says it was taken by Windham’s girlfriend, Alana Wallace, who was subsequently taken into custody for resisting arrest.

Breiner believes the video shows his client was not resisting arrest and that the officers used unnecessary force during the arrest.

鈥淲e鈥檙e definitely going to take it to the police commission,鈥 Breiner said. 鈥淚 thought the actions of the two officers was abhorrent.鈥

The Honolulu Police Commission investigates citizen complaints against officers. It can also investigate cases of unnecessary or excessive use of force.

While the cell phone video only shows a point in time, Breiner says the incident highlights the need for police body cameras.

The Honolulu Police Department currently does not use the technology.
