The fight over Honolulu rail’s lucrative $1.4 billion core systems contract isn’t over.

Disqualified rail bidder Bombardier on Thursday filed an appeal in the state Intermediate Court of Appeals, protesting a lower court’s ruling that upheld the rejection of the company’s proposal.

The city’s procurement office had disqualified Bombardier’s bid for technical reasons, and awarded the contract to Ansaldo in March.

Bombardier appealed the city’s decision to the state Department of Commerce and Consumer Affairs, which threw out the case in July. (The same DCCA hearings officer rejected an appeal by the other losing bidder, Sumitomo.)

Bombardier then took its complaint to Circuit Court.

A Circuit Court judge in September rejected the appeal. The court had ruled that the DCCA hearings officer correctly decided that the city did conduct meaningful discussions with Bombardier about the deficiency in its proposal, as required by law.
